Welcome to Manufique (“we,” “our,” or “us”).
These Terms and Conditions (“Terms”) govern your access to and use of manufique.app, our software platform, and any related services (collectively, the “Platform”).

By accessing or using Manufique, you agree to be bound by these Terms. If you do not agree, please discontinue use immediately.

1. Definitions

  • “Platform” refers to all websites, applications, and services operated by Manufique.

  • “User,” “you,” or “your” refers to any individual or entity accessing or using the Platform.

  • “Content” means all data, files, text, images, or information uploaded, created, or stored by users.

  • “Base44” refers to the secure cloud infrastructure used by Manufique for data storage and processing.

 

2. Acceptance of Terms

By using the Platform, you confirm that:

  • You are at least 18 years old or legally eligible to enter into a binding contract.

  • You have read, understood, and accepted these Terms and our Privacy Policy.

  • If you use Manufique on behalf of a business or organization, you have authority to bind that entity to these Terms.

 

3. Service Description

Manufique provides an all-in-one ERP and CRM solution for jewelry manufacturers, allowing users to manage inquiries, quotations, production workflows, invoices, inventory, and communication in a single platform.

All services are cloud-based and hosted securely on Base44.

 

4. Account Registration

To use certain features, you must create an account.
You agree to:

  • Provide accurate and complete information during registration.

  • Keep your login credentials confidential.

  • Be fully responsible for any activity under your account.

Manufique reserves the right to suspend or terminate accounts that violate these Terms or are found to contain false or fraudulent information.

 

5. Data Storage and Security

All user data and uploaded content are securely stored and processed through Base44, our private backend infrastructure.

Manufique and Base44 implement encryption, access controls, and backups to protect your data.
However, you acknowledge that no online system is completely immune from security risks, and you use the Platform at your own risk.

Manufique shall not be liable for any loss, damage, or unauthorized access beyond reasonable preventive measures.

 

6. Data Ownership and Intellectual Property

You retain full ownership of all data, designs, files, and content you upload to the Platform.
Manufique acts solely as a data processor and does not claim any ownership or intellectual property rights over your materials.

However, you grant Manufique a limited, non-exclusive license to host, store, and process your content solely for the purpose of operating and improving the Platform.

All Manufique software, trademarks, designs, text, graphics, and intellectual property are owned by Manufique and protected by international copyright and trademark laws.
Users may not copy, modify, or distribute any part of the Platform without written permission.

 

7. Acceptable Use

You agree not to:

  • Upload or transmit any unlawful, abusive, or harmful content.

  • Attempt to access other users’ data or interfere with Platform security.

  • Reverse-engineer, decompile, or copy the Platform’s source code.

  • Use the Platform to develop competing software.

  • Use the Platform for any illegal or fraudulent activities.

Violation of these rules may result in suspension or permanent termination of your account without refund.

 

8. Payment and Subscriptions

Certain features require a paid subscription. By purchasing a plan:

  • You authorize recurring billing based on your selected plan (monthly or annual).

  • Fees are non-refundable once charged.

  • Pricing and features may be updated; notice will be provided in advance.

  • Failure to pay will result in temporary suspension or permanent termination of your account.

All payments are securely processed via third-party payment providers (e.g., Stripe, PayPal) and subject to their respective terms.

 

9. Service Availability

We strive to keep the Platform available 24/7, but we do not guarantee uninterrupted or error-free access.
Maintenance, updates, or technical issues may cause temporary downtime.
Manufique shall not be liable for any business losses arising from such interruptions.

 

10. Termination

You may terminate your account at any time by contacting manufique.app@gmail.com.

Manufique reserves the right to suspend or terminate access if:

  • You violate these Terms.

  • You engage in fraudulent or harmful activity.

  • Required by law or regulatory authority.

Upon termination, your data will be deleted in accordance with our Privacy Policy, unless legal obligations require otherwise.

 

11. Limitation of Liability

To the fullest extent permitted by law:

  • Manufique and its owner shall not be liable for any indirect, incidental, or consequential damages, including loss of profits, data, or goodwill, arising from your use of the Platform.

  • Our total liability under these Terms shall not exceed the total fees paid by you in the three (3) months preceding the claim.

You agree to use Manufique at your own risk and acknowledge that no system is entirely free from technical errors, downtime, or cyber threats.

12. Indemnification

You agree to indemnify and hold harmless Manufique, its developers, owner and affiliates from any claims, losses, damages, or expenses (including legal fees) arising from:

  • Your use or misuse of the Platform.

  • Violation of these Terms.

  • Any infringement of third-party rights caused by content you upload or share.

 

13. Updates and Modifications

Manufique reserves the right to update or modify these Terms at any time without prior notice.
Revised Terms will take effect immediately upon posting on manufique.app.
Continued use of the Platform after updates constitutes acceptance of the revised Terms.

 

14. Disclaimer of Warranties

The Platform and all related services are provided “as is” and “as available,” without any warranties, express or implied.
We make no guarantees regarding uptime, data accuracy, or performance.

You acknowledge that software and internet-based services inherently involve risks, and you agree that your use of Manufique is entirely at your own discretion and responsibility.

 

15. Governing Law and Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of your country of residence, without regard to its conflict of law principles.

Any dispute arising out of or related to these Terms shall be submitted to the exclusive jurisdiction of competent courts in your jurisdiction.

17. Entire Agreement
